This, what is turning out to be, unscrupulous vendor provided a seemingly snake oil treatment to help reduce or eliminate diabetes, and promised me that if within the prescribed period I was not weaned off my medication they would refund the cost of the treatment, and add an additional $500.00. Although my sugar levels did come down somewhat I was not able to get off my medication by the end of the prescribed period, but when I asked for the refund they refused because they said I had not submitted my food reports exactly as they had asked. I believe this was just a subterfuge to avoid giving the refund. I offered to negotiate with them, and even provide the sales receipts of all the foods they had me buy, as well as corroborating testimony by my family, even to do the program over, but they adamantly refused and left me with the sad conclusion that all they were after was my money not matter what, and they never had the intention to refund anything, or even entertain my complaint to reach an amicable resolution.

He didn''t qualify for a refund.  It''t refute it. When we offer a guarantee like we do for a lifestyle change program, it''t live with our clients and therefore we have no idea whether they are following our program or not.... so the only way we can ensure that as much as possible is to require a weekly check in and daily food log once a week. He didn''s telling us he has proof he followed the program as directed... yet with no food logs, we can''s not off his meds after this 2 month program is done, he will not ask for a refund, nor will he post any negative comments about us anywhere.

Complaint: ********

I am rejecting this response because: The response by HYD/Dr ******* is unacceptable because it is disingenuous at best, and fraudulent at worst. Dr. ******* lies when he states that there were no food logs. In fact there were, and I submitted them to HYD, and to the BBB in ******* which is where I contracted to receive this treatment. To accept his offer to redo the program with the same result at the end and then not get the promised refund is akin to saying heads I win tails you lose, and it shows Dr ******* does not believe in his own product, and is not willing to live by his promise to refund. The clause about submitting the reports weekly rather than all at once could only by found in the initial receipt, but nowhere else in the program guidelines, and and I already admitted that it was a mistake on my part because I neglected to go back to that initial contract until the end of the program and I had forgotten all about that and no efforts were done whatsoever to remind me even though the program was monitored by a Dr ******* on a weekly basis. To deny the refund due to a mistake when all other requirements were met, and a willingness to provide signed affidavits by my wife and family to show that I indeed followed the program shows that Dr ******* is not interested in honoring his promise but to employ every possible subterfuge to avoid issuing a refund. It is no wonder that seemingly everywhere this company operates it holds an FFF rating from the BBB. I am willing to redo the program and if I still did not get off the meds then the refund would still be offered, or I would accept a partial refund now and end this charade. If a reasonable partial refund is offered, and accepted, I will cease all current and pending action against HYD.

I signed affidavit doesn''s supposed to be and the requirements are crystal clear.  I''t.  We give out refunds to patients who follow these requirements and are not off their meds.  When offering a guarantee like we do, it''t.  To ensure we don''t do.  Case closed.  Saying "" or "" doesn''t do what was required to get a refund, so no refund is due.  If he continues to post or say or write negative things about us with the intent to harm our reputation, when we did nothing wrong, then our attorney will file a suit against him for slander, as we won''ll put up my reputation against this outfit any time and the implication that me or my family would not tell the truth is truly libelous and subject to additional litigation, but they have tried to protect themselves from the many disgruntled customers they probably have by requiring arbitration. If he is willing to sue me for libel then let him drop the requirement for arbitration, and let an impartial court of law hear the case from both sides. I am still hopeful, and willing to compromise by redoing the program and if at then end I am not off my meds get the refund, or accept a partial refund. If not I will continue to pursue justice until the end of time, if that what it takes.

Help your Diabetes guarantees that they will get a **** * diabetic into remission, and off of all their Meds in * months. If the plan doesn''t work for us. it turns out my son is a **** diabetic, 10% to 15% of all **** * diabetics Have ******* ********** ********* *****) and may be misdiagnosed and treated as **** *. My son is among the 10% to 15%. We did not get off of any Meds, and did not get into remission. HYD refuses to give us a refund - we did not know about ****, and were not told it was a possibility. Their team apparently are not Medical Doctors contrary to the implications in their introduction video, but they still should know that not all **** * clients are diagnosed correctly. That shouldn''ve mentioned he is Special ED.  I highly suggest you set it up so you have Power of Attorney over his medical decisions, since you made it clear he has issues with reading and thought processes and needs an advocate.  If this is truly the case, he shouldn''s up to his primary to determine whether he is **** *, * or has ****.  If ******** previous physician didn''t know if ****** was **** * or *, even though they said he was **** *.  If they did run these tests initially, and they were negative, and now they are positive, then that would prove he has ****.  If they weren''s more likely ****** was **** * from the beginning, but just misdiagnosed.  So his current physician can''m telling you this so you have all the facts.  So, did ****** have a ********* test or insulin antibody test done by his initial primary doctor?  I''m open to a partial refund, but not full because we provided almost all the service we agreed to provide ****** and we relied on his initial physicians diagnose that he was a **** * and we acted accordingly.  It was only after we suggested that ****** be tested for **** * that you even found out that he actually is a **** * or has ****.

I''t able to get off of diabetic medication. I am not on diabetic medication right now and they said that the refund policy doesn''t. I received a call the following evening, but I missed the call. I called back and they didn''t work and would he provide me the information. He spent more time asking me about my email storage. The call took about 5 minutes in total. He chastized me about my A1C results and just really didn''t be a refund. . Icommunicated mostly via email with ***** at the HYD office. He assured me that the program is worth it. That I can listen to weekly calls and information etc. I told him that I would prefer to change to a different doctor if I stayed with the program. He explained via email that they didn''t want any other deductions from my HSA card and that I wanted to cancel. I still wanted a refund of my $500, but now the first payment from the finance company for an additional $280 was deducted on 12/2/2019. They are making it seem like I have no recourse to cancel this program. I received a box from them of I don''t opened it. They gave me a box on day one will cleansing pills and a coaster and I have used it. I want to cancel right away, because if I continue with the program and it is what my gut tells me that they won''t have recourse because I would have already started the program. I am a single person and only have my income. The cost of their program is not disclosed until the very end. They offer financing options right away and I just really thought they would offer superior services. d

As with all our clients, she signed an agreement that stated all sales are final, there will be no refunds and she will not attempt to cancel any finance agreements.  She initialed and signed this agreement, therefore no refund is legally due.  We provided proprietary patent pending information that she already has.  We will continue to provide the services we agreed to provide,  but she needs to follow the recommendations if she expects results.  If she is confused about our simple one page agreement, she should seek advice from an attorney.  The agreement is simple and clear and she willingly signed and initialed it.

I am rejecting this response because:

 - This company operates on emotion and shock value.  I was shown a video and at the end it showed someone having a surgical procedure and their toes were cut off. All of them.

 - HYD has a 30 day guarantee that if a client is on medication they will eventually reverse their diabetes and not take medication anymore, but it takes longer than 30 days to get to that point if possible.  So the guarantee wouldn''t have in their documentation anything for someone who isn''t it seem suspicious that they don''t utilized and products I haven''t offer any guarantees for clients that are not on medication, that want to cancel, or have a dispute.  This tells you that this company is not reputable and I am sure I won''t even opened the box and don''t use their coaster either.

- I sent the below email to HYD that I didn''t authorize any more charges to my card.  They did it anyway.  I want a refund.

*****,

I called on Friday 11/22 hoping to catch you. I will not start the program. For the 7k expense of this program I expected more for my money. I asked to be reassigned to another doctor for support and you said he is the only one.

I don’t have the confidence to start your program and then be dissatisfied again and have no recourse.

I do want $500 payment refunded since I technically haven’t started but I will leave it to my attorney to look into that.

Don not continue to charge my HSA card. I do not allow it.

Your confirmation of my email is appreciated.

Thank you.

She willingly signed a legal agreement, which states no refunds, she can''s advice. I am requesting BBB arbitration or assistance to get HYD to honor their guarantee.

To qualify for the guarantee, patients need to follow the program as directed and send in a daily food log every week. He did not send in a food log every week and on at least one occasion when he sent in a food log, it showed he ate things that had sugar, soy and other ingredients not approved on our plan. Because he didn''t qualify for the guarantee or a refund.

I wanted to advise you of responses I have received from Dr. * ****** ********* the *********** of Help Your Diabetes.  He has sent me two emails since I filed my complaint ID ********.  I responded to both emails with a copy of my meal logs and a response to his later comments. (see the attachments)

My counselor, Dr. *******, never asked for the meal logs.  I started sending them in after I reviewed the paperwork I had received when I paid for the program.  I began to suspect that failing to send in the meal logs would be a reason to abrogate the Help Your Diabetes refund guarantee.

Dr. * ****** ******** has not responded to my last response to his email.  I suspect that he may respond to my BBB complaint by making the same claims to BBB: 1) no meal logs, & 2) no breakfasts.  I answered both of his claims by supplying the meal logs and explaining my late night schedule.  If any of these issues were that important I would have expected my counselor, Dr. *******, to advise me of a change I needed to make.  Please consider my answers to his claims as you process my complaint.

Thanks,

I told this patient it doesn''t be following the plan or healthy for him.... and skipping a ton of breakfasts and snacks is no different.  It''t follow it, therefore no refund is due.  That''s information. He handed me a box of supplements and a diet program which he didn''t for me. I called the loan company and told them I did not want the loan and they said no problem we will cancel the loan and close the account. I called Help Your Diabetes the next day and told them I changed my mind it wasn''t change your mind. You don''t get a refund. I told him I would bring all the information and the supplements back. he said well that makes no difference. You signed and you need to do the program or don''t get a refund. I told him I had canceled the loan. He said well corporate will still charge you.I then called the loan company ********* and to make sure they didn''t use their services. They are fighting the refund.

This patient signed legal agreements stating all sales are final and there are no refunds.  Our staff explained everything to him and he still CHOSE to sign up.  He was not pressured into anything.  He initialed and signed the agreement.  He was told about the no refund policy and he initialed and signed it.  He left with our proprietary "" information that has taken us over a decade to create and he could have easily copied all the information before returning it and there would be no way for us to know that.  Signing up for the financing option he chose took a lot of time, so he had time to take 2 minutes to read the agreement he signed and initialed with us stating no refunds. Once the finance company was provided with the agreements he signed, they told him they can''t aware of what is included in our program isn''t allow patients to take advantage of us.  Since there will be no refund, we suggest this patient contact us to get started on the program so he can reverse his diabetes, which he told us he wanted to do. We will provide all the services we agreed to provide.

This patient willingly signed a legal agreement stating all sales are final and there are no refunds unless he takes advantage of our guarantee, which he hasn't.   His statements are false that he was rushed, etc.  He read, signed everything and was given copies of all he signed.  We have and will provide all the services we agreed to provide.  He is trying to take advantage of us because he was given all our proprietary information and is now trying to breach the legal contract he signed.  He needs to contact us and get back on track so he can get all the services he paid for.
